I'm no expert on CPSIA and it's 1 am, but this idea has been in my head. I'm not endorsing my thoughts just thought this would be and interesting approach to CPSIA. If the clothing were marketed it midgets and dwarfs could you circumvent CPSIA Law? Maybe I've been watching to many Jack In the Box commercials, that's where the idea came from.

Little people might be the same height as children but proportionally, their bodies are not the same size or shape.

Also - if you were a mom, looking for clothes for your kids - and don't know anything about CPSIA - you're not going to be looking for little people clothes until the situation becomes so extreme that your children are running around naked and for whatever reason you are incapable of making them yourself.
